Intermittent Tracker →What Every U.S. Employer Must Know About FMLA Compliance
The Family and Medical Leave Act (FMLA) grants eligible employees up to 12 workweeks of unpaid, job-protected leave per year for qualifying family and medical reasons. Managing FMLA requires strict adherence to federal statutory timelines, precise leave calculations, and defensible recordkeeping.
Employer & Employee Coverage
Applies to private employers with 50 or more employees for 20+ workweeks in the current or preceding year. Employees qualify if they have worked for 12 months, completed 1,250 hours of service, and work at a location with 50+ staff within 75 miles.
The 4 Leave Calculation Methods
Employers can choose one of 4 statutory 12-month methods: (1) Calendar year, (2) Fixed 12-month period, (3) 12-month period measured forward, or (4) Rolling 12-month period backward (recommended by DOL to prevent employee leave stacking).
DOL Statutory Timeline Deadlines
When an employee requests leave, HR must issue Form WH-381 (Eligibility Notice) within 5 business days. Once medical certification (WH-380) is returned, HR must issue Form WH-382 (Designation Notice) within 5 business days.
